Oswaldtwistle Rape Sex Offender Declan Ashley Whiteley ‘strangled’ a woman on her bed as he sexually assaulted her. The Oswaldtwistle Sex Offender was invited back to her home after a night out and while she was changing her shoes in her bedroom he tried to pull her onto the bed but she said ‘that’s not happening’.
Declan Ashley Whiteley then pushed her over and put one hand on her neck trying to kiss her, the court heard.
The victim rolled over with the quilt to get him off her and fell onto the floor before Declan Ashley Whiteley said he was ‘not going to hit her’ and called her an ‘idiot’.
Declan Ashley Whiteley, 24, then pulled her back onto the bed and ‘put both his hands around her neck with his thumbs on the windpipe’.
As the victim shouted his hands got ‘tighter’ and he told her ‘you are going to give me what I want, aren’t you?’
The victim was crying and struggling to breathe and eventually punched him twice to the face before running out of her home for help.
In a victim statement she said she is considering moving home and is ‘scared and emotional’.
Declan Ashley Whiteley was found guilty after a magistrates trial of sexual assault.
He was sentenced to to a 10-month jail sentence, suspended for two years, with a 12-month curfew requirement.
Declan Ashley Whiteley was also ordered to sign the sex offenders register for seven years and given a seven-year restraining order.
